Crew contract

 

  1. Safety: The skipper is responsible for the safety of ship and crew during the sailing trip. The skipper decides on the deployment framework of the fellow sailors, taking into account their skills and resilience. Sailors must follow the skipper's instructions and carry out the activities assigned to them carefully and conscientiously. At sea, on the instructions of the skipper, each participant wears a life jacket and, if necessary, a life belt. A co-sailor can be forced to abort the trip if the co-sailor disrupts the trip through their own behavior and defies the skipper's orders. There is then no entitlement to (even partial) reimbursement of the trip fee.

  2. Smoking and alcohol is at your own risk. If you want and have to, you can do so with consideration for the fellow sailors. Smoking is strictly forbidden below deck! Seafaring and alcohol seem to go hand in hand, but they only get along on a low level.

  3. Meals and board cash: The crew will set up a "board cash" into which each crew member pays at the start of the trip. A member of the crew is designated as cashier. Alternatively, an app can also be used. The community costs such as port fees, deposit insurance and purchases for food on board as well as the diesel costs are paid from the on-board cash box. The skipper is traditionally fed on board by the crew. At the end of the trip, the board cash will be settled, any surplus will be paid out, any underfunding will be compensated. 

  4. Tasks and liability of the skipper: The skipper assumes the task of managing the ship in accordance with the required seamanlike prudence and the seafaring care of the fellow sailors. His instructions must be followed on board. He imparts sailing knowledge and can and should entrust crew members with tasks. Gross negligence cannot be derived from this alone, insofar as these tasks have been declared and can be reasonably expected. At the beginning of the trip, a crew member is appointed as co-skipper, who takes over his rights and obligations in the meantime if the skipper is unable to make decisions or is unintentionally absent.

  5. Trip preparation: The skipper independently ensures conscientious preparation. Taking into account the weather conditions, the possibilities and wishes of the crew and the seaman's assessment of the situation, the skipper determines the route and destination, which can also deviate from an initially planned route. Reduction or claims for damages are excluded in this regard. Except for gross negligence and intent, any mutual liability is excluded. This applies in particular to damage to life, limb, health and property. Each crew member takes part in this trip at their own risk and waives claims for compensation from all legal points of view for all damages against the skipper, the other crew members and the organizer. This also applies to travel, cancellation or similar costs incurred by the participant because a trip has to be canceled or aborted. The exclusion of liability also applies to any carpooling for the purpose of arriving and departing from the departure point of the trip. Insurance must be taken out privately. Shore excursions etc. are undertaken at your own risk. No liability can be accepted for damage, accidents, losses and delays. The participant bears the transport risk. Loss of use caused by an accident during the trip does not lead to any reimbursement, not even partial. This waiver of liability also includes claims of indirectly injured parties for whom the participant is or may be obliged to provide maintenance or who is obliged to provide services

  6. Liability for damage by the crew: The crew and skipper are responsible for ensuring that the yacht remains in perfect condition. As the user of the yacht, the crew is jointly liable for the operation and occupancy of the yacht (yacht damage, third-party damage, consequential damage or loss of equipment, etc.), insofar as the damage is not covered by the existing yacht insurance (fully comprehensive and liability insurance). The deductible for fully comprehensive insurance is ____€. By taking out deposit insurance, the risk can be reduced to 0€. With your signature, you confirm that you are fully responsible for yourself, that you can swim uninterruptedly in deep water for at least 15 minutes without aids, that you treat the material provided - i.e. the ship and equipment - with care and are ready to carry out the necessary work To be carried out on board together with the other crew members. Please let us know in good time if you have any acute or chronic illnesses and/or physical limitations that require special care or medication. Meteorological events such as strong winds and rough seas can cause considerable physical stress. This does not constitute a defect.
